  1. ACCEPTANCE OF THE TERMS AND CONDITIONS

1.1. The publication or digital media revistaprimetime.com is owned by Revista PrimeTime. The access, participation and use of the Revista PrimeTime is governed by the Terms and Conditions established herein, which are understood to be known and accepted by the User of the Revista PrimeTime, for which reason the User will be understood as the person who accesses, participates or interacts with the Revista PrimeTime (hereinafter, the “User”). This implies your full and unconditional adherence to these Terms and Conditions.

If at any time the User does not fully or partially agree with these Terms and Conditions, they must immediately refrain from having any link with the Revista PrimeTime services in any of its parts or sections or portfolio, otherwise any use or link with it will presume that the User unreservedly accepts the Terms and Conditions of use and under his full responsibility.

1.2. Revista PrimeTime reserves the right to make modifications to these Terms and Conditions at any time, for example to deal with changes in the Law or regulations, make or negotiate adjustments to agreements or strategic alliances, commercial links or changes in the functionalities and services offered to through the website.

1.3. Given the binding nature of these Terms and Conditions, it is the sole responsibility of the User to review the Terms and Conditions in force at any time.

 

  1. USE OF THE PUBLICATION OR DIGITAL MEDIA

2.1. The access to, and/or use of the Revista PrimeTime that attributes the condition of User, accepts from said access and/or use, the Terms and Conditions of Use reflected here, as well as those governed by mutual agreement and is obliged to comply with the same.

2.2. Revista PrimeTime provides access to various services, programs or data owned by Revista PrimeTime, or third parties, to which the User may have access. 2.4. The section of Revista PrimeTime “Services” is intended exclusively for Users over 18 years old. The contact in said section of the digital publication, by persons under 18 years old, will be purged, rejected or omitted. Terms and Conditions of Use. By entering the “Services” section of Revista PrimeTime, the User guarantees that he is over 18 years old, and accepts and agrees to comply with all the Terms and Conditions established herein.

2.5. Revista PrimeTime authorizes the User to consult, review and use the published material found in the digital publication, solely for personal and non-commercial use.

2.6. The unauthorized use of Revista PrimeTime may constitute a violation of Colombian or foreign laws on copyright, industrial property laws or other laws.

2.7. The User acknowledges and accepts that any question, comment, suggestion, idea, feedback, material and/or any other related information shared publicly for mass dissemination in Revista PrimeTime will not be confidential. It will be considered that the User is the owner of the copyright on said content and, having been included in Revista PrimeTime, grants a free, unconditional and non-exclusive license to use such content in favor of PrimeTime Magazine, without the right to receive consideration, remuneration, compensation or any subsequent claim, whatever its type or nature. Revista PrimeTime may in turn make any type of use of said material, by virtue of the license of use thus granted.

 

  1. USER REGISTRATION

3.1. In order to be informed of the news and developments provided in Revista PrimeTime through press bulletins by mailing, the User must register through the Feed or Form provided by Revista PrimeTime. In either case, Revista PrimeTime will store the User’s personal data in the corresponding database.

3.2. To consult or access the services offered by Revista PrimeTime, the user must contact the email servicios@revistaprimetime.com provided in “Services”. In either case, Revista PrimeTime will store the User’s personal data in the corresponding database.

3.3. By registering by any of the means indicated in the previous numeral, the User agrees to: i) Provide true, updated and complete information about himself as may be requested by any of the registration forms of the Revista PrimeTime website (hereinafter “Registration Data”), ii) Maintain the security of your identification, iii) Maintain and constantly update the Registration Data and any other information provided to Revista PrimeTime, iv) Be fully responsible for all use of the newsletters sent, v ) Commit not to create multiple User accounts, or accounts with third-party data vi) Receive information via email about the products or services of Revista PrimeTime.

 

  1. PRIVACY POLICY

4.1. It is in the interest of Revista PrimeTime to protect the privacy of the User’s personal information obtained through digital publication, committing to adopt a confidentiality policy as established below.

4.2. Personal information is understood to be that provided by the User for registration, which includes data such as: name, identification, age, gender, address, email and telephone. 4.4. Revista PrimeTime is not responsible for any consequence derived from the improper entry of third parties into the database and/or for any technical failure in the operation and/or conservation of data in the system in any of the chapters of the digital publication.

4.5. Revista PrimeTime does not guarantee that unauthorized third parties may not have knowledge of the class, conditions, characteristics and circumstances of the use that Users make of the digital publication.

4.6. Who completes the registration feed to receive mailing, accepts that their data is incorporated into the Revista PrimeTime databases. In any case, the User may at any time request the withdrawal of their personal information from the Revista PrimeTime databases, for which they must send an e-mail to contacto@revistaprimetime.com

 

  1. PRESS AND MAILING

5.1. Users who want information about what’s new in Revista PrimeTime may subscribe through the official feed or form provided by Revista PrimeTime or through the email prensa@revistaprimetime.com to receive alerts or self-promotions about new content, services, products, news, exclusive publications or communications of interest from Revista PrimeTime.

5.2. Users who access advances or digital alerts may use them solely for informational purposes and not for commercial or other purposes. The i) Texts; official communications, reviews, information on Revista PrimeTime content, ii) Photos or images by Revista PrimeTime iii) Videos, promos or trailers on Revista PrimeTime content, iv) Audio or music tracks related to Revista PrimeTime productions, v) Interviews exclusive of any actor or artist who participates or has participated in Revista PrimeTime productions, vi) Advances, vii) Short-stories, literature or texts, ix) Journalistic notes x) self-promotion of products such as souvenirs or merchandising, or related to content, services or Own products are subject to copyright and intellectual property of Revista PrimeTime.

5.3. Users will be able to access digital alerts or progress in their email to be informed. If you need to reproduce and/or communicate any of its contents, you will always do so for the exclusive purpose of illustrating some event or news related to Revista PrimeTime.

5.4. In the event of retransmitting audiovisual, photographic, multimedia, textual or musical material, to contextualize or illustrate your journalistic notes, you can do so as long as you respect the relevant copyright, with the permissions requested for use by the company and you must bring when mentioning them or refer them, courtesy or credit of Revista PrimeTime.

5.5. The Material may not be used by users under any circumstances for commercial purposes or for any activity or purpose other than that established in the previous numeral.

5.6. Similarly, Journalists assume responsibility for the use and management of the Material and undertake not to use it to: i) distribute it, ii) violate any applicable law or regulation, iii) infringe copyright or intellectual property of Revista PrimeTime or third parties and/or to the other uses established in the following numeral.

5.7. The User who is registered to be able to receive advances or digital alerts from “Press” of Revista PrimeTime, undertakes to maintain the strictest confidentiality and reserve about the contents and information obtained, different from the Material authorized in numeral 5.4.; as well as any information or document that you may come to know as a consequence or during the use of the Portal, with the exception that it is used only for the purposes established in this section.

 

  1. SERVICES AND ADVERTISING

6.1. The services offered by Revista PrimeTime in consultancy, information, advice and project management in the field of Information Technology and Communications, refer to *Strategic Communications (Press, Communications, Covers, Creative Content). *Management of projects in (Audiovisual, Design and Multimedia – ICT), which include phases of construction, design-assembly, realization and operation. *Digital (Web Development – Programming, Responsive and interactive UX – UI Design), which includes development of web pages or applications, user experience and navigability design, use of new technologies and programming languages. – These services are provided in a personalized way for clients who are interested in contracting them. For its achievement, Revista PrimeTime charges according to a list of costs or established annual rates and also under quotation. For the provision of some services, Revista PrimeTime contemplates agreements entered into with external Providers who, given their professional talent, support the management of the project in its different phases of planning, design, operation and delivery, in this sense the agreed agreements will be governed by a written document, signed and agreed between the parties.

6.2. The purpose of the services offered is to guide, advise, guide or manage ideas, initiatives or projects of users or third parties. Consulting or project management, strategic or digital communications derived from the contracting of the service, are subject to the confidentiality and conditions established between Revista PrimeTime, the client and the provider, if applicable.

6.3. For any query, request for information, rates or contracting of the services offered by Revista PrimeTime, users or third parties may communicate via email servicios@revistaprimetime.com

6.4. Revista PrimeTime does not accept any request from users or third parties, who try to hire the services for purposes that commit a crime, demeaning, illegal action or that violates human rights or minors.

6.5. Revista PrimeTime does not accept or provide any of the services offered, without having been contracted, agreed or agreed upon directly between Revista PrimeTime, the client or, as the case may be, the allied provider.

6.6. The commercial guideline or advertisements that are published in the Revista PrimeTime, are arranged because a client paid for their diffusion in it. The rate charged to the client is defined according to a list of costs or annual rates established by Revista PrimeTime

6.7. The value invoiced by Revista PrimeTime to the client will be according to the price of the banner, scroll, ad, review, article or promotional note taking into account the section, space, time and size where it is located in the digital publication, as well as if the design or animation is prepared by the company and/or its suppliers for the client, and according to the number of seconds and periodicity that the advertising guideline published in the digital publication will be maintained.

6.8. The publication of the banner, scroll, ad, review, article or promotional note is for commercial purposes only and Revista PrimeTime is not responsible for the type of promotions, discounts, products or services offered by the advertising client. However, it refrains from disseminating commercial guidelines that have obscene, violent messages or that violate human rights or minors.

 

  1. USER CONDUCT

7.1 The User agrees to make appropriate use of the content and services that Revista PrimeTime or third parties offer through the digital publication, including but not limited to, not to use it for: i) Engaging in illicit, illegal or contrary to good faith and public order, ii) Disseminate content or propaganda of a racist, xenophobic, pornographic nature, in support of terrorism or violation of human rights; iii) Causing damage to the physical and logical systems of PrimeTime Magazine, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage; iv) Try to access and, where appropriate, use the User accounts of other Users and modify or manipulate messages; v) Register more than one User account, register a User account on behalf of another person or register a User account on behalf of a group or entity; vi) Impersonate another person or entity, make false representations or provide false information about himself, his age or his relationship with any person or entity; vii) Uploading, posting, transmitting, sharing, storing or facilitating unauthorized or unsolicited advertising, unlawful solicitations, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other type of communications illegal or commercial; viii) Collect email addresses or other contact information from other Users through digital publishing by electronic means or other means for the purpose of sending unsolicited emails or other unauthorized communications; xix) Use automated scripts to collect information through the digital publication or to interact in any other way with them; x) Collect and/or disclose their own personal data or that of third parties; xi) Impersonate the identity of any User; xii) Harass, annoy or intimidate other Users; xii) Upload, post, transmit, share, store or facilitate content that constitutes, incites or provides instructions to commit crimes, that violates the rights of a third party, gives rise to liability or violates any local, state, national or international law ; xiii) Upload, publish, transmit, share, store or facilitate content that, in the sole opinion of Revista PrimeTime, is questionable or that restricts or prevents the use or enjoyment of the digital publication by other people, or that may expose the Revista PrimeTime or its Users to damages or liabilities of any kind; xiv) Request personal data from minors under 18 years old or request passwords or personal data for commercial or illegal purposes, xv) Upload, publish, transmit, share or facilitate material that contains computer viruses or any other code, file or computer program designed to interrupt, destroy or limit the functionality of any software or hardware or telecommunications equipment; xvi) Include in the Revista PrimeTime information or material that is protected by copyright laws, unless the User is the owner of such rights or has obtained permission from the owner of such rights and xvii) include information or material that reveals industrial or commercial secrets.

 

  1. WEBSITES AND THIRD PARTY CONTENT

8.1. Revista PrimeTime contains (or it is possible that the User receives through the Portal) links to other websites (the “Third Party Sites”), as well as articles, photographs, text, graphics, images, designs, information, and other content. or items belonging to third parties and originating from third parties (“Third Party Content”).

8.2. Revista PrimeTime does not check or verify the accuracy, adequacy or completeness of such Third Party Sites, or the Third Party Content found in the digital publication and is not responsible for Third Party Sites accessed through Revista PrimeTime. nor of the Third Party Content that is published in the digital publication, which can be accessed through Revista PrimeTime that is installed from it, including with regard to content, accuracy, offensive nature, opinions, the reliability, privacy policy or other policies of Third Party Sites or Third Party Content. The inclusion of any Third Party Content, the creation of links to any Third Party Site or any Third Party Content or the authorization of Revista PrimeTime for the use or installation of any Third Party Site or Third Party Content in the digital publication does not mean that the Revista PrimeTime endorses or sponsors such Third Party Sites or Third Party Content.

8.3. If the User wishes to leave the digital publication and access the Third Party Sites, they will do so at their own risk, in which case they acknowledge and accept that the Conditions and Policies of Use of the Revista PrimeTime will cease to be applicable. In this way, the User must consult the applicable Conditions and Policies, including the privacy and data collection policies, of any site accessed through the digital publication.

8.4. Likewise, the establishment of any type of link by Revista PrimeTime to another website will not imply any type of relationship, collaboration, association, merger or participation between Revista PrimeTime and the person responsible for the linked website.

8.5. The links or links to other Internet pages, other than those of which Revista PrimeTime is the owner, are offered as a service to Users. In the event that these links or linked links are in advertising banners, they will only be published as a commercial guideline, in the parameters of costs, location on the screen, size of the banner, design or animation, periodicity and transmission agreed with the client who decided to advertise in Revista PrimeTime. Therefore, Revista PrimeTime is not involved in the production or promotional content displayed, nor in the products or services that they may offer.

 

  1. OWNERSHIP OF THE CONTENT OF THE DIGITAL PUBLICATION

9.1. All the content of the Revista PrimeTime and available through it or the products and services it provides, including designs, text, graphics, images, video, information, applications, software, sound, and other files, as well as its selection and order (the “Revista PrimeTime Content”), are the exclusive property of Revista PrimeTime or third parties that by legal mandate or express authorization have conferred Revista PrimeTime the right to use or exploit them, with all rights reserved.

9.2. The acceptance of these Terms and Conditions does not imply in any case the acquisition by the User of the intellectual or industrial property rights related to the Revista PrimeTime or its Content. Revista PrimeTime does not grant any license or authorization for use of its industrial and intellectual property rights or any other property or right related to this Portal, therefore its total or partial reproduction, translation, inclusion, transmission, distribution is prohibited, downloading, publishing, storing, accessing or selling in any way, in whole or in part, by any means created or to be created, without the prior written consent of Revista PrimeTime.

9.3. The User may not upload or republish the Revista PrimeTime Content on any Internet, Intranet or Extranet site or integrate the information into any other compilation database; any other use of the Revista PrimeTime Content is strictly prohibited. Excepted from what is established in this numeral is the use of the Material that is authorized to Journalists in accordance with the provisions of the fifth numeral of this document.

 

  1. EXCLUSION OF LIABILITY

10.1. Occasionally, the digital publication may be unavailable for maintenance or other reasons. Revista PrimeTime does not assume any type of responsibility for errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communications line failure, theft, destruction, unauthorized access or alteration of the User’s communications. Revista PrimeTime is not responsible for any technical failure, nor for any other problem of the network or telephone service, software, applications, email or server failures caused by technical problems or traffic congestion on the Internet or in any site, including injury or damage to the User’s or another person’s computer, mobile phone, or any other piece of hardware or software, arising from the use or downloading of materials in connection with the digital publication or its services.

10.2. Revista PrimeTime will not be in any way responsible for loss or damage or personal injury or death, derived from the use by any person of the digital publication, its services, or any content or software, published in it or transmitted to the Users.

10.3. Revista PrimeTime, the services, applications and digital publication content are provided “as is” and Revista PrimeTime expressly disclaims all representations and warranties, express or implied, including the implied warranties of title, merchantability, fitness for a specific purpose and non-infringement. Revista PrimeTime cannot guarantee and does not promise any specific results derived from the use of the digital publication, its services, material or any application of the platform itself. Revista PrimeTime does not represent or warrant that the software, content, or materials of the digital publication, its services, or platform applications are accurate, complete, or reliable, or that they are up-to-date or error-free, or that Revista PrimeTime, the service, its servers or the applications of the platform are free of viruses or other harmful components. Consequently, the User must exercise caution when using and downloading said software for the detection and disinfection of viruses recognized in the sector.

10.4. Without limiting the general nature of the previous provision, the User acknowledges and accepts that in the event that he downloads or obtains content, material, data or software through the digital publication or any application of the platform at his own risk, he will be the only responsible for the use you make of them, for any damage that your mobile device or computer system may suffer, and for the loss of data or other damage that may arise.

10.5. Revista PrimeTime reserves the right to modify any content, software and other elements used or included in the digital publication and in any platform services and applications offered through Revista PrimeTime  at any time and without prior notice. References to products, services, processes or other information through trade names, brands, manufacturers, suppliers or others, do not constitute or imply that Revista PrimeTime approves, sponsors or recommends such products, services, processes or information, nor that it has any relationship with these.

10.6 In any case, Revista PrimeTime will not be responsible for the opinions or comments expressed by Users through blogs or other participation tools of the digital publication.

10.7. Limitation of liability; In no case will Revista PrimeTime, its directors, employees or agents or suppliers, be liable to the User, or other third parties for any type of damage, including loss of benefits or data derived from the use of the digital publication or its services, the applications of the platform, the content of the Revista PrimeTime or other materials that have been accessed through the digital publication or downloaded from it.

 

  1. APPLICABLE LAW

The User, when visiting or making use of Revista PrimeTime or its services, accepts that the laws of the Republic of Colombia will regulate these conditions of use as well as any dispute that may arise between him and Revista PrimeTime or with any of our affiliates.

 

  1. ARBITRATION

Revista PrimeTime and the User agree that, except as otherwise indicated with respect to certain specific services of the digital publication, in any specific terms and conditions applicable to it, the exclusive jurisdiction and the only legal action in case of conflicts or claims in relation to these conditions of use, the Revista PrimeTime or its services, will be arbitration. To the maximum extent permitted by applicable law, no arbitration proceeding or claim that refers to these terms and conditions of use may be consolidated with other arbitration proceedings or claims.

 

  1. GENERAL PROVISIONS

These Terms of Use constitute the entire agreement between the User and Revista PrimeTime in relation to the use of the digital publication and its services, and supersede all previous agreements between the User and Revista PrimeTime in relation to the use of the digital publication or its services. Failure by Revista PrimeTime to exercise or enforce any right in these Terms of Use will not constitute a waiver of that right. If any provision of this contract is declared invalid, the rest of this contract will remain in force in all its aspects. If any provision of these Terms of Use is declared illegal, void or unenforceable for any reason, that provision will be excluded from these Terms of Use without affecting the validity and enforceability of the remaining provisions.
